INVESTIGATION:
This report is to be read in conjunction with all other reports generated under this Record Division
Number. This report is a summarization of all reported information as well as all interviews and is not
to be considered verbatim.
On 14 Sep 2023, reporting detective (R/D) was assigned the homicide investigation of
which occurred at 60 E. Monroe Street, Cook County, Chicago IL 60603. Sgt KOLMAN
#2000 of the Area Three command assigned R/D this case. Sgt KOLMAN related an individual was
shot in a condo building and the shooter called 911 reporting he had shot someone. R/D along with
Sgt KOLMAN, Det COSTANZO and Det DRISKILL proceeded to the scene. This case is reported
under the Chicago Police RD# JG-424436.
R/D arrived on scene and noted 60 E. Monroe St to be the Legacy Building at Millennium Park, a
72-story skyscraper, located along S. Wabash Ave. The Legacy Building is comprised of
condominium units, rental apartments, as well as street level commercial retail spaces. R/D
observed numerous marked and unmarked Chicago Police vehicles parked at the entrance to the
Legacy Building. Beat 111, manned by P.O. KARMA #18282 and P.O. MENDOZA #13292 were
assigned as the transporting officers for the offender, . was subsequently
transported to Area Three Detective Division.
R/D then entered the lobby of 60 E. Monroe and was met by Beat 167 Sgt GILLILAND #1895 who
directed R/D to witnesses and . Sgt GILLILAND related two
additional witnesses departed the area after the shooting (later determined to be and
). R/D learned is a resident of 60 E. Monroe St, and
is a door man for the Legacy Building. and were then interviewed independently in
the office spaces of 60 E. Monroe St. R/D and Det COSTANZO interviewed staff member
while Sgt KOLMAN interviewed resident .

related earlier in the day, on 14 Sep 2023, he was employed as "Door staff" for the Legacy
Building. was known to residents by his nicknames of or . received a
call at the front desk from a resident stating there was a person knocking on doors and screaming
on the 29th floor. further related the resident caller stated he did not know the person.
then called 911 and requested police assistance. Please refer to the Office of Emergency
Management, audio recorded, service call event# 2325712868 at 1921 hours for a complete and
accurate account of the 911 call.
elicited the help of a custodian after receiving multiple calls from residents of
the 29th floor concerning a disturbance. relocated to the 29th floor in an effort to

investigate the source of the disturbance. was requested by as did not
want to leave the front desk position unattended. returned and related there wasn't
anyone located in the 29th floor hallway. explained "a married couple" (now known as
residents and ) then came to the building's front desk and reported a male
Black yelling in the elevator. and informed that a male Black was
yelling while he exited the elevator on the 48th floor. and observed the male
Black as they entered the same elevator he was exiting.
was then approached at the front desk by an additional resident who notified him of an
individual causing a disturbance. described him as "the shooter" ("the shooter" is now known
as ). said , and , and ( ) all joined
in heading to the 48th floor in an attempt to locate the male Black who was yelling in the
hallway. noted was a friendly resident who regularly hangs around the front lobby desk.
is known to help with issues arising with the computer based security camera system.
said the group was worried for other tenants after hearing reports of a person in the building
screaming and knocking on doors.
related himself, , and , and , exited the elevator on the 48th
floor, and the group immediately heard screaming and someone pounding on doors.
observed a male Black in a black robe say, "Hey buddy, what happened?". described a
feeling of relief because he believed the male Black knew someone in his group. The male Black
then "rushed" and struck him with a fist two to three times in the side of the head. The closed
fist strikes that received caused him to fall backward into the wall. struck his elbow on
the wall and fell into the group of people behind him. According to the male Black then struck
in the jaw causing him to fall to the ground unconscious. described and
as being behind him when he started to back up. then said, "I have a gun, I have a
license.". stated the male Black "punched the shooter, and the shooter fired four to five
shots". was then observed by as he began to crawl away as backed up toward
the elevator. , , , and and all relocated back downstairs to
the front desk via an elevator. It was then activated the Police Panic Alarm button located at

event# 2325713127 at 1937 hours where a third party alarm company notified 911 of a panic alarm
activation.
told investigators he realized he recognized the male Black as a resident he believed to be
named .

event. related he went to pick up food and upon returning saw the doorman, , on the

phone taking a call of a disturbance on the 29th floor. then requested the maintenance man
check it out. further related before the maintenance man returned, calls from the 48th floor
began coming in of disturbance on that floor. , , an older couple, and the offender who
are all residents went to investigate.
said, upon arriving on the 48th floor, exited first followed by then the older couple
(now known as the ) and the offender. Screaming could be heard to their right and down
the hallway. described the hallway having a dead end where you must turn right or left. The
group walked to the end of the hallway toward the screaming and shouting and encountered
(the victim) first and asked , "What was wrong?" then rushed
toward and began to strike him about the head and body. tried to fend off the attack
and began to retreat. At some point, ended up behind and then struck
one time in the face causing him to fall to the ground. believed he was "knocked out" for a bit
of time.
went on to describe that he heard one shot and felt someone pull him down the hallway away
from . related he then got up off the floor under his own power and began to move
toward the elevator. did not see who shot. did not know any witnesses involved except
the doorman.

R/D, Sgt KOLMAN, Det COSTANZO, and Det DRISKILL relocated to the 48th floor in order to
process the crime scene. R/D observed the 48th floor to be an L-shaped main hallway bisected by a
bank of elevators. The L-shaped hallway was built in an east/west orientation. The west end of the
main L-shaped hallway terminates with a perpendicular, smaller, unit access hallway. The crime
scene was protected by Beat 0122 with yellow crime scene tape securing the section of the hallway
which was located west of the elevator bank. Unit #'s 4806 make up the western
portion of the 48th floor. R/D observed a gold chain, a gold pendent, and a gold charm on the
carpeted floor in front of Unit# 4804. An apparent bullet hole was located in the floor baseboard
between Unit #'s 4803 and 4804. A suspected red blood stain was located just south of the
intersection where the unit's hallway intersects with the main hallway. Five (5) 9mm expended shell
casings were observed near the intersection of the main hallway and the unit's hallway, in a line in a
north/south direction, directed toward Unit# 4806. Six small suspected red blood stains were
observed on the east and west walls closest to Unit# 4806 in similar fashion to a blood spatter
pattern. Please refer to the crime scene video and photos for further information.
Evidence Technicians CAHUE and DEL TORO arrived on scene, and walked the scene with R/D.
R/D pointed out items of evidentiary value to CAHUE and DEL TORO. Crime scene markers, further
referred to as CSMs, #1-8 and CSM A were placed. CSMs #1-5 were designated for 9mm expended
shell casings. CSM# 6 highlighted a fired bullet. CSMs #7-12 were designated for the various pieces
of jewelry located on the floor nearest to unit# 4804. A small orange cone denoting CSM A was
placed marking the suspected red blood stain where responding police located the victim .
White and black tape markers labeled A, B, C, D, E, and F were then placed on the wall highlighting
suspected red blood stain splatter. Suspected red blood stain markers A, B, and F were swabbed for
potential biological material. Evidence was video recorded, photographed, and recovered and given

peephole of her door, and observed a male Black banging on her door. utilized her cell

provided to the Area Three Technology Center and R/D via email. Please refer to inventory#
15375000 for the complete video. then related she called "911" to report hearing an unknown
number of shots.

4803 to no avail. At 2120 hours R/D was then alerted to Unit# 4803 opening the door to speak with
investigators. The occupant was an elderly White female who wished to not give her name or
information. R/D informed the resident R/D was investigating a shooting in the hallway. The resident
related she heard loud talking in the hallway but did not hear any gun shots. The female White
thought the talking she heard "may have been building maintenance" personnel. The female White
related she resided in the unit with her husband who was located in the bedroom sleeping, and her
husband was asleep at the time of the shooting. R/D requested permission to enter her residence in
order to locate the bullet that was fired into the baseboard from the hallway. R/D was granted
access, and R/D with Det DRISKILL inspected the interior of the kitchen cabinets which are affixed
along the condo/apartment side of the hallway wall. R/D could not locate a fired bullet inside the
cabinets nor a bullet hole.

button to leave the 48th floor. said the elevator door opened and a male Black in a
blue robe starting yelling "Fucking white crackers". The male Black then exited the elevator before
and entered. described the male Black as "yelling and
pounding" as he walked toward Unit# 4802. along with rode the
elevator to the first floor.
related he and his wife approached the building's front desk to inform them of the
male Black on the 48th floor. spoke to at the front desk. was
concerned she may have not locked their front door and wished to go back up to the 48th floor to
confirm the door was secure. It was then , , , , and a
resident (now known as ) who said "I have a license to carry" all went to the 48th floor.
said, "the elevator opens and we hear yelling". did not know what the
individual was saying. stated, "the guy was pissed, angry out of his mind" when he
referenced the demeanor of the male Black. went on to describe the male Black
attacking the group with the group falling backward into each other 'like dominos".
said was struck and was observed to be "wobbling". heard several gunshots as
he was falling backwards. went on to say all the residents then entered the elevator
except the guy who was shot.
then said he remembered, in the past, he would consistently see a Chicago Police
Squad car parked around the corner from his residence. then relocated to Wabash
Ave and summoned the officer who was assigned a fixed post at that location. spoke
to Det TORRES #20806, and informed him there was a shooting and the victim was injured. Det
TORRES followed to the 60 E. Monroe lobby. observed being
detained by the Chicago Police Department personnel.

Erie in order to process the remains of the victim . At 2322 hours on 14 Sep 2023,
Dets arrived and observed secured in the morgue guarded by P.O. ALVAREZ #7861 of
Beat 163A. was unclothed, intubated, and within a human remains bag. had
sustained gunshot wounds to the right side of the chest, the left axilla, the abdomen (two times), the
left forearm, and left ring finger. ETs photographed the remains of and evidence
preservation bags were placed on both hands to protect potential biological material. Please refer to
Crime Scene Report# 515976 for further information concerning the Forensics Services Section
processing of the 60 E. Monroe and Northwestern Hospital crime scenes.

resided. said he relocated to 60 E. Monroe and saw several police and fire
department vehicles parked with their emergency lights activated. overheard police and

was involved in the shooting that took place. then observed being taken to a
Chicago Fire Department ambulance via a stretcher. then contacted brother
and informed that his brother had been shot. furnished

telephone at 0009 hours on 15 Sep 2023. R/D phoned due to living in the
state of Georgia. related there was no known mental health issues with , but
was concerned with becoming mentally exhausted. related
had a prescription for Adderall. related to R/D he would get an airline ticket to Chicago as
soon as possible.
R/D and Det COSTANZO returned to the Area Three Detective Division in order to interview the
offender . 's arrest is documented under CB# 30280646. It was then R/D
learned that P.O. SALMERON #9459 of Beat 161C recovered a firearm from 's front pants
pocket. The firearm recovered was found to be (1) Sig Sauer P938, Serial# 52E078120, 9MM,
SEMI-AUTOMATIC PISTOL, 3" BARREL LENGTH, BLUE STEEL containing a silver magazine and
live rounds. The firearm was inventoried under inventory# 15424810.
While in interview Room E was read rights under Miranda by Det MONTALVO #21047 at
2155 hours on 14 Sep 2023 in the presence of Det STRAZZANTE #21121. Dets MONTALVO and
STRAZZANTE began the interview due to R/D processing the scene and interviewing witnesses.

down". said he heard his door handle moving. related he called the door man and
then he called "911". further related he "thought he was on drugs because he was talking
about someone behind the mirror". related the individual was "clearly not rational".

After struck , described drawing his gun and then striking
. believes the elderly couple fled. described as he ran toward him
and said he backed into a dead end corner. said he fired when was about
six feet away. believes he fired three (3) rounds. stopped firing because the gun was
slipping from his hands. related fell on top of him after he fired. then got
up, patted the front of his body, and walked toward the opposite corner of the hallway.
R/D joined the interview with Dets MONTALVO and STRAZZANTE at approx. 0118 hours on 15 Sep
2023

want any of his neighbors to get hurt. said, " he was moving toward me, I fired." did
not recall saying anything before firing or after firing.

On 15 Sep 2023 R/D contacted the Cook County States Attorney's Office and advised them there
was an individual in custody and charges for First Degree Murder would be sought.
On 15 Sep 2023, Dr. ECKHARDT performed an autopsy on the remains of and
determined the cause and manner of death to be Multiple Gunshot Wounds / Homicide. An external
examination revealed: Gun Shot Wound (GSW) #1 to the right upper chest, GSW #2 to the
abdomen (lodged), GSW #3 entered the right abdomen and exited right flank, GSW #4 to the left
axilla (lodged), GSW #5 entered and exited the left forearm, and GSW #6 entered and exited the left
hand ring finger. An internal examination by Dr. ECKHARDT revealed: one projectile recovered from
chest, one projectile recovered from clothing, and one projectile recovered from the spinal column.
Projectiles were inventoried by Beat 5809 Evidence Technician J. CONNELL# 19974 under
inventory# 15375123. left fingernails were recovered and inventoried under inventory#
15375124. Buccal swabs, finger prints, and a blood card were administered to . The robe
worn by at the time of the homicide was inventoried under inventory# 15375125.

recovered from was conducted where a test fire confirmed the shell casings
recovered from the scene at 60 E. Monroe St are consistent with having been fired from the Sig
Sauer P938 fired by and inventoried under inventory# 15374980.
On 15 Sep 2023, Cook County Assistant States Attorney GALLAGHER arrived in Area Three
Detective Division and conducted interviews of the witnesses of this homicide. The interviews
occurred in the Area Three Homicide office with no other witnesses present.
was interviewed by ASA GALLAGHER with R/D being present. essentially
related the same facts of this case but went on to describe demeanor in more detail.
told ASA GALLAGHER that had, "vengeance in his eyes, and there was no

would ask "how are you doing?". said was a "different person"
when he was shot. related he sought medical treatment after leaving work on the night of the

On 11 Dec 2023 R/D met with legal counsel representing the victim's family. At 1633 hours Attorney
Jason FRIEDL of the law firm Romanucci and Blandin tendered an iPhone, that belonged to the
victim, to R/D. The victim's iPhone was located when the family of was cleaning out his
apartment after his death. family believes an audio recording captured the audio of the
homicide of . A memo drafted by the law firm documenting the iPhone turnover to R/D was
signed by R/D. IPhone inventoried under inventory# 15424810. A data extraction was performed on
the victim's iPhone and (3) Optical discs each inside an envelope along with a copy of the receipt
from the law firm Romanucci and Blandin were inventoried under inventory# 15464853.A phone
audio file recovered from the victim's iPhone, contains a male voice stating erratic statements and a
speech which contains a high respiratory rate. The male voice went from excited, to crying, to being

On 08 Feb 2024 R/D contacted the Cook County States Attorney's Office with an update on this
case.
On 01 May 2024 R/D met with Cook County Assistant States Attorney Jennifer McCarty with an
update on this case.
On 03 May 2024 R/D received Toxicology results from Det ANDINO who was assigned to the Cook
County Medical Examiner's Office. NMS Labs, a third party, produced work order# 23362891 where
toxicology results revealed the following substances: 11-Hydroxy Delta-9 THC,
Amphetamine (Adderall etc), Benzoylecgonine (cocaine derivative), Delta-9 Carboxy THC, and
Delta-9 THC. These results were forwarded to the Cook County States Attorney's Office.
R/D made several attempts to locate witnesses to present to the Cook County States Attorney's
Office. R/D attempted phone and in-person contact with Ying " on six occasions.
, , and were contacted by R/D via telephone/text on
several occasions.
R/D scheduled interviews to be conducted on 30 May 2024 with ,
, and in order to be interviewed by the Cook County States Attorney's Office.
R/D was contacted by who related himself and his partner would not be presenting
themselves to be interviewed. contacted R/D on 29 May 2024 and he requested he seek legal
counsel and related he would not be attending the interview on 30 May 2024.
On 06 Jun 2024 R/D requested present himself at The Area Three Detective
Division in ordered to be interviewed by the Cook County States Attorney's Office. ASA
CHAMBERS interviewed where related essentially the same version of events as
he related to investigators. further related that was "talking crazy, and out
of his mind".
R/D again attempted to contact witnesses , ,
, and on several occasions. After not gaining cooperation with availability for
interviews R/D drafted Grand Jury subpoenas for , , , and . R/D was
able to serve subpoenas upon , , and . R/D could not locate after four
attempts in person and numerous phone calls. Subsequently R/D placed a copy of the subpoena
under the door of MING.
Pursuant to a subpoena, on 28 Aug 2024, witnesses and presented themselves
to the Cook County States Attorney's Office located at 26th and California, Cook County, Chicago IL
in order to be interviewed by ASA CHAMBERS. R/D was present during the interviews of
and . Both and related the same version of events as they were
related to investigators in this case except recalled hearing what he describes as "a punch
striking a meaty surface" before he heard shots being fired. went on to voice his
displeasure with a firearm being involved in a disturbance in his hallway.

Cook County States Attorney's Office located at 26th and California, Cook County, Chicago IL in

On 29 Aug 2024 failed to present herself to the Cook County States Attorney's
Office in order to be interviewed. On 04 Sep 2024 R/D drafted a subpoena for to present
herself to the Cook County States Attorney's Office. The subpoena for was unable to be
served due to being unable to locate .
On 23 Oct 2024 was not present at 26th and California to be interviewed by the Cook County
States Attorney's Office.
On 30 Dec 2024 R/D met with Cook County Assistant States Attorney Jennifer McCarty with an
update on this case.
On 02 Jan 2025 R/D executed a search warrant for the iPhone possessed by offender
during the time of the shooting. The iPhone inventoried under inventory# 15374982 was
hand carried by R/D to The Regional Computer Forensics Laboratory located at 610 S Canal St,
Chicago, IL 60607. R/D requested a data extraction be performed. Data extraction results were
pending gaining access through security features of the iPhone.
On 07 Feb 2025 R/D contacted Cook County Assistant States Attorney Jennifer McCarty with an
update on this case.
On 07 Mar 2025 R/D spoke with the Cook County States Attorney's Office Assistant States Attorney
Jennifer McCarty at 1354 hours who rejected Charges for First Degree Murder.
Summary:
On 14 Sep 2023, R/D was assigned the Homicide Investigation of which occurred
at 60 E. Monroe St. R/D learned was shot inside the hallway of a condo building
on the 48th floor, and the shooter, , was placed in custody on scene by Beat 161C.
was pronounced by Dr. JOUNG on 14 September 2023 at 2011 hours at Northwestern
Hospital. R/D learned a weapon was recovered from 's pocket. That weapon was found to be
a Sig Sauer P938 9mm semi-automatic handgun and subsequently inventoried under inventory#
15374980. was transported to Area Three Detective Division for investigation. R/D
conducted a walk-through of the crime scene in the hallway of the 48th floor of 60 E. Monroe St with
Evidence Technicians CAHUE #5005 and DEL TORO #8853. Within the hallway, R/D observed
suspect red blood stains on the walls, an apparent bullet hole in the hallway baseboard, One (1)
fired bullet, and five (5) 9mm expended shell casings. All of the evidence was subsequently
recovered and inventoried by evidence technicians.

, and building door staff member who were present during this

Miranda rights by Det MONTALVO at 2155 hours on 14 Sep 2023. waived his right to
counsel and related while in his condo he heard someone trying to "bang the door down".

related he called the door man and then he called "911". further related he "thought
he was on drugs because he was talking about someone behind the mirror" referencing the
individual outside his door he believed to be most likely Black. related the individual was
"clearly not rational". relocated to the lobby after the individual departed his hallway.
said he was joined by four other people who were headed to the elevator to go the 48th floor.
related he didn't expect anything to go wrong with a group of people. related to Dets
MONTALVO and STRAZZANTE that he observed the male Black on the 48th floor strike
with a knife or possible weapon.
went on to describe displaying his gun and the victim then striking . believes
the elderly couple fled. said the male Black ran toward him. stated he backed into a
dead end corner. said he fired when the male Black was about six feet away.
believes he fired (3) rounds. stopped firing because the gun was slipping from his hands.
On 15 Sep 2023, R/D was notified by the Chicago Police Forensic Firearms Lab that an evaluation
of the firearm recovered from was conducted where a test fire confirmed the shell
casings recovered from the scene at 60 E. Monroe St are consistent with having been fired from the
Sig Sauer P938 fired by and inventoried under inventory# 15374980.
On 07 Mar 2025, R/D spoke with the Cook County States Attorney's Office Assistant States Attorney
Jennifer McCarty and presented the facts of this case. After reviewing the facts of this investigation,
ASA McCarty Rejected Charges for First Degree Murder at 1354 hours.
R/D requests this case be placed into an Exceptionally Clear Closed (Other Exceptional) Bar to
Prosecute status.
